Illinois Surety Bonds— Four Agencies, One Bond Source

Illinois splits bond authority across four state agencies -- IDFPR, IDPH, the Secretary of State, and the Department of Insurance -- plus dozens of municipalities with their own rules. From $5,000 notary bonds to $2,000,000 cannabis cultivation bonds, the range is wider than most principals expect.

Recent changes add complexity: the public adjuster bond doubled to $50,000 in January 2024, notaries now face an exam requirement, and a new money transmitter law takes effect January 2026. We track every change so you do not have to.

Illinois Cannabis Surety Bonds

Among the highest bond amounts of any state license type

Illinois requires surety bonds at every stage of cannabis licensing. The amounts are substantial -- up to $2,000,000 for cultivation facility construction -- and the surety market is limited because federal classification restricts which carriers will write these bonds. We work with the small number of Treasury-certified sureties authorized to issue cannabis bonds in Illinois. Use our license bond calculator for a premium estimate.

Dispensary Bond

$50,000

Required for all retail dispensary licenses. Protects the state against regulatory violations and ensures compliance with the Cannabis Regulation and Tax Act.

Cultivation -- Construction Phase

$2,000,000

Required during facility build-out. Guarantees the cultivation site will be completed according to plans submitted with the license application.

Cultivation -- Production Phase

$1,500,000

Replaces the construction bond once the facility is operational. Ongoing compliance bond for the duration of the cultivation license.

Why Cannabis Bonds Cost More

  • --Federal Schedule I classification limits the number of sureties willing to underwrite cannabis bonds
  • --Higher perceived risk drives premiums to 3-10% of the bond amount
  • --Detailed financial underwriting required -- personal credit alone will not suffice
  • --Industry experience and business plan quality significantly affect pricing

Construction and Court Bonds

Public Construction Bonds

Under the Illinois Bond Act (30 ILCS 550), public construction projects above the $150,000 temporary threshold require both a 100% performance bond and a 100% payment bond. These protect the government entity and ensure subcontractors and suppliers are paid.

Illinois Surety Bond Questions

Covering recent law changes, cannabis bonds, and multi-agency requirements

Why did Illinois double the public adjuster bond to $50,000 in January 2024?
The Illinois Department of Insurance raised the public adjuster bond from $20,000 to $50,000 under 215 ILCS 5/1560, effective January 2024. The increase was driven by a surge in storm-related claims fraud, particularly in the Chicago suburbs and downstate tornado corridors. The higher bond amount gives consumers greater financial protection when a public adjuster mishandles or misappropriates claim proceeds. Existing adjusters had to file a new or rider bond to meet the higher threshold by the effective date.
How much does an Illinois cannabis surety bond cost?
Cannabis bond costs depend on the license type and bond amount. A $50,000 dispensary bond typically costs $2,500-$5,000 per year (5-10%) because cannabis is still federally classified as a controlled substance, which limits the surety market. Cultivation bonds -- $2,000,000 for construction-phase and $1,500,000 for production-phase -- cost significantly more and require detailed financial underwriting. Expect premiums of 3-8% depending on the applicant's financials, cannabis industry experience, and the surety's risk appetite.
Do Illinois notaries now need to pass an exam to get bonded?
Yes. Since January 2024, all new Illinois notary applicants must pass a state-administered exam before the Secretary of State will issue a commission. The bond requirement itself has not changed -- $5,000 for standard notaries under 5 ILCS 312/2-101 and $30,000 for electronic/remote online notaries -- but you must pass the exam before you can file your bond and receive your commission. The exam covers notarial acts, identity verification, and Illinois-specific legal requirements. The 4-year commission term remains the same.
What is the difference between state and municipal contractor bonds in Illinois?
Illinois has no statewide general contractor license bond. Only roofers ($10,000 or $25,000 depending on license class, under IDFPR) and plumbers ($20,000 under IDPH) carry state-level bonds. However, municipalities set their own requirements: Chicago requires a $10,000 general contractor bond, Aurora requires $20,000, Naperville $10,000, and Cook County $20,000. If you work in multiple cities, you may need separate bonds for each jurisdiction. Electrical contractor bonds are municipal-only in Illinois -- there is no state-level electrical bonding requirement.
What changes are coming to Illinois money transmitter bonds in January 2026?
Illinois is adopting the Uniform Money Transmitter Modernization Act (UMTMA), effective January 2026. Under the new law, money transmitter bond amounts will range from $100,000 to $2,000,000 based on transmission volume. This replaces the current bonding framework and aligns Illinois with the multistate model. Existing licensees will need to adjust their bond amounts by the effective date. The new law also changes reporting requirements and supervisory authority, so current money transmitters should begin transition planning now.
How do Illinois currency exchange bonds work with multiple locations?
Illinois requires currency exchange operators to post a $25,000 surety bond per location, with a maximum aggregate of $350,000 regardless of how many locations you operate. So a currency exchange with 5 locations needs $125,000 in total bonding, but an operator with 20 locations still only needs $350,000. Bonds are filed with IDFPR and must be issued by a surety authorized in Illinois. Premiums depend on the operator's financial strength and claims history.
What bond do I need to open an immigration assistance center in Illinois?
The Illinois Attorney General requires immigration assistance service providers to post a $100,000 surety bond under the Illinois Immigration Assistance Act. This bond protects consumers from fraud and ensures the provider follows state rules about what services non-attorneys can offer. The bond must be in place before the AG will register your business. Premiums typically run 5-10% of the bond amount depending on your credit and business history.
Can I get an Illinois surety bond with bad credit?
Yes. Notary bonds ($5,000 and $30,000) require no credit check and are approved instantly. For larger bonds like the $50,000 auto dealer bond or $100,000 credit services organization bond, applicants with credit scores below 600 can still get approved through our high-risk surety partners. Expect premiums of 5-12% of the bond amount rather than the 1-3% that strong-credit applicants pay. Cannabis bonds are underwritten primarily on financials and industry experience rather than personal credit alone.
