Massachusetts Little Miller Act -- Public Works Bonds

Under MGL c.149 §29, performance and payment bonds equal to 100% of contract value are required for public construction contracts of $25,000 or more. This applies to contracts with the Commonwealth, counties, cities, towns, and districts.

The payment bond specifically protects subcontractors and material suppliers who cannot file mechanics liens against public property. Subcontractors must notify the general contractor of their claim within 65 days of completing their work. The general contractor's surety then has 90 days to investigate and resolve the claim before litigation begins.

Paper Applications Are Gone: The New MA Contractor Hub

Mandatory online system replaced paper applications on January 5, 2026

As of January 5, 2026, the Office of Consumer Affairs and Business Regulation (OCABR) moved all HIC registration and renewal to the MA Contractor Hub -- an online-only portal. Paper applications and certified checks are no longer accepted for any contractor registration activity.

Contractors who previously mailed paper applications and certified checks must now create an online account. The system accepts credit/debit card and ACH payments.

Processing times have shortened under the digital system -- most registrations are processed within 5-10 business days versus 3-4 weeks under the paper system.

The CSL (Construction Supervisor License) remains under the Division of Occupational Licensure and is not part of the MA Contractor Hub. Massachusetts vehicle dealers must separately maintain a Massachusetts auto dealer bond through the RMV. Contractors also operating in neighboring Connecticut face a different $15,000 HIC bond through the DCP rather than a guaranty fund contribution.
